These Terms are intended to comply with the laws applicable in British Columbia and Canada, including consumer protection, privacy, and general contract principles. If any mandatory law applies to you and conflicts with these Terms, the mandatory law will prevail to the extent of the conflict.

We reserve the right to modify, discontinue, or substitute any service, content, instructor, venue, method of delivery, or materials where reasonably necessary for operational, safety, educational, or business reasons.
Unless expressly stated otherwise in writing, our services are educational and consultative in nature. We do not guarantee any specific business, financial, technical, operational, or artistic results, including but not limited to sales performance, drink quality, equipment performance, or customer satisfaction outcomes.
3. User Obligations and Responsibilities
You agree to:
- Provide accurate, current, and complete information when booking or participating in our services;
- Ensure that all participants under your booking or supervision comply with these Terms;
- Arrive on time and follow all instructions, safety rules, and staff directions;
- Use equipment, beverages, tools, and facilities responsibly and only as instructed;

- Not record, photograph, livestream, reproduce, or distribute our proprietary materials, demonstrations, methods, or content without our prior written consent, except as permitted by law;
- Comply with applicable laws, regulations, and venue rules, including health and safety requirements.
You acknowledge that participation in coffee preparation, equipment use, tasting, and related activities may involve hot liquids, sharp tools, electrical equipment, slip hazards, allergens, caffeine consumption, and other inherent risks. You accept responsibility for your own conduct and, where applicable, the conduct of persons under your supervision.
We may refuse service, remove a participant, or terminate a session without refund if we reasonably determine that a participant is unsafe, disruptive, intoxicated, abusive, or otherwise in breach of these Terms.
4. Payment Terms and Conditions
All fees, deposits, and charges are due as stated at the time of booking, invoicing, quotation acceptance, or written agreement. Unless otherwise specified, prices are quoted in Canadian dollars (CAD) and may be subject to applicable taxes, including GST/HST/PST where required by law.
Payment methods accepted may include credit card, debit card, e-transfer, bank transfer, online payment processors, or other methods we make available from time to time. You authorize us and our payment processors to charge the payment method provided for all amounts due, including applicable taxes, late fees, cancellation fees, no-show fees, and other amounts owing under these Terms.
If payment is not received when due, we may suspend, cancel, or refuse to provide services, and we may charge interest on overdue amounts at the rate permitted by law, or if no rate is prescribed, at a reasonable commercial rate notified to you in writing. You are responsible for all collection costs and reasonable legal fees incurred in recovering overdue amounts, to the extent permitted by law.
Quotes and proposals are valid only for the period stated therein or, if no period is stated, for a reasonable time and may be withdrawn or revised before acceptance. Any custom consulting, corporate training, travel, venue, equipment, ingredient, or special supply costs will be billed as agreed in writing.
5. Cancellation and Refund Policy
Cancellations and rescheduling requests must be made in writing via our contact information. The applicable cancellation terms may vary depending on the service type, booking size, venue, and whether the service is custom or private. Unless a different policy is stated in a booking confirmation or written agreement, the following default policy applies:
- More than 14 days before the scheduled service: Eligible for rescheduling once or a refund, less any non-refundable processing or administrative fees, if applicable.
- 7 to 14 days before the scheduled service: Eligible for rescheduling once, subject to availability, or a partial refund at our discretion, less non-refundable costs already incurred.
- Less than 7 days before the scheduled service: Non-refundable, except where required by applicable law or at our sole discretion.
- No-shows or late arrivals: No refund. Sessions may be shortened or forfeited without credit if the participant arrives late.
For corporate, custom, private, or off-site engagements, deposits are generally non-refundable once work has been scheduled, materials have been procured, or preparation has begun, except as required by law or expressly agreed otherwise in writing.
If we must cancel or materially reschedule a service due to operational reasons, safety concerns, illness, venue issues, or other reasons within our control, we will make reasonable efforts to offer an alternative date, credit, or refund as appropriate. Our liability in such circumstances is limited to the amount paid for the affected service, to the extent permitted by law.
Refunds, when approved, will be issued to the original payment method where feasible and may take a reasonable processing period. Any chargebacks or payment disputes made without first contacting us to resolve the issue may result in suspension of future bookings and recovery of related costs to the fullest extent permitted by law.
6. Liability Limitations
To the fullest extent permitted by applicable law, Maple Peak Barista Studio Ltd., including its directors, officers, employees, contractors, instructors, agents, and representatives, shall not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profit, revenue, business opportunity, goodwill, data, or anticipated savings, arising out of or in connection with the services or these Terms, whether in contract, tort, negligence, strict liability, or otherwise, even if advised of the possibility of such damages.
To the fullest extent permitted by law, our total aggregate liability for any claim arising out of or relating to the services or these Terms shall not exceed the amount actually paid by you to Maple Peak Barista Studio Ltd. for the specific service giving rise to the claim.
Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable law, including liability for fraud, wilful misconduct, gross negligence where such exclusion is prohibited, or any other liability that may not lawfully be limited in British Columbia or Canada.
You acknowledge that coffee-related activities may involve inherent risks. You assume all risks associated with participation, including personal injury, allergic reactions, burns, cuts, equipment misuse, and property damage, except to the extent caused by our gross negligence or wilful misconduct where liability cannot lawfully be excluded.
You are responsible for ensuring that you and any participants under your booking are medically fit and suitable to take part in the services. We do not provide medical, nutritional, or health advice. Any tasting or consumption of coffee, dairy, syrup, alcohol-infused ingredients, or other products is at your own risk and subject to applicable laws and venue rules.

You may not copy, modify, reproduce, republish, distribute, sell, sublicense, publicly display, or create derivative works from our materials without our prior written consent.
If we provide customized consulting deliverables or business recommendations, ownership of our pre-existing intellectual property remains with us. Unless otherwise agreed in writing, you receive a license to use the deliverables internally for your own business purposes, but you may not resell or commercially exploit our proprietary frameworks, methods, or materials.

If a force majeure event occurs, we may suspend, reschedule, modify, or cancel the affected service. We will use reasonable efforts to notify you and, where appropriate, offer an alternative date, substitute service, credit, or refund in accordance with applicable law and the circumstances of the event.
10. Changes to Terms
We may update, revise, or replace these Terms at any time to reflect changes in our services, business practices, legal requirements, or operational needs. The updated Terms will be posted or otherwise made available with a revised effective date.
Your continued booking, use, or participation in our services after updated Terms are posted constitutes acceptance of the revised Terms, to the extent permitted by law. If you do not agree to the revised Terms, you must stop using our services and, where applicable, cancel future bookings in accordance with the then-current cancellation policy.
11. Applicable Law and Jurisdiction
These Terms and any non-contractual obligations arising out of or in connection with them shall be governed by and construed in accordance with the laws of the Province of British Columbia and the federal laws of Canada applicable therein, without regard to conflict of law principles.
You agree that the courts of British Columbia, sitting in Vancouver, shall have exclusive jurisdiction over any dispute arising out of or relating to these Terms or the services, subject to any rights you may have under applicable consumer protection laws that cannot be waived by contract.
